At the heart of most if not all foreclosure actions in the state of Florida and throughout the country for loans transferred into the secondary market (securitized) is Plaintiff’s claim they are the holder of the Note and that is all that matters. And although UCC Article 3 and Article 9 arguments are important to help discount Plaintiff’s holder claim, there is one important factor many overlook – they MUST hold the ORIGINAL note! The keyword is the ORIGINAL, a distinction overlooked by most when they see a blue signature however, it has been established by the banks themselves that it was common practice to destroy notes to maintain their electronic transfer databases. It now appears in every foreclosure case the Note was not destroyed but is now actually present. From excellent automated machine driven original forgeries of borrower signatures in blue ink to top-notch color copies, more and more notes are proven to be fake.
